These Terms of Service ("Terms") govern your use of DayCue ("DayCue," "we," "us"). By creating an account or using DayCue, you agree to these Terms. If you do not agree, please do not use DayCue.

1. Eligibility

You must be at least 13 years old to use DayCue. If you are under the age of majority where you live, you may use DayCue only with the involvement of a parent or guardian who agrees to these Terms.

2. Your account

You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that happens under your account. Notify us promptly if you believe your account has been accessed without your permission.

3. Acceptable use

You agree not to:

• Use DayCue for any unlawful purpose or in violation of these Terms;
• Use it to harass, harm, deceive, or spam anyone;
• Store or use other people's information in a way that violates their privacy or applicable law;
• Attempt to disrupt, reverse engineer, or gain unauthorized access to DayCue or its systems.

4. Your content and the people you add

You own the content you create in DayCue, including your templates, cues, and the information you add about the people in your life. You grant us a limited license to store and process that content solely to operate DayCue for you. You represent that you have the right to add and store the information you enter about other people, and you are solely responsible for how you use it, including any messages you choose to send.

5. Messaging

DayCue helps you prepare messages, but you send them yourself through your own device and messaging apps. You are responsible for the content of anything you send and for complying with any laws that apply to it.

6. Service availability and changes

We are continually improving DayCue and may add, change, or remove features. We may also suspend or discontinue the service, in whole or in part. We will try to give reasonable notice of significant changes.

7. Disclaimer

DayCue is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that DayCue will be uninterrupted, error-free, or that reminders will always be delivered on time.

8. Limitation of liability

To the fullest extent permitted by law, DayCue and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed reminders, or missed communications arising from your use of the service. Our total liability for any claim relating to DayCue will not exceed the greater of the amount you paid us in the prior twelve months or USD $50.

9. Termination

You may stop using DayCue and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use DayCue in a way that could harm others or the service.

10. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules, except where applicable consumer-protection law provides otherwise.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you in the app. Continuing to use DayCue after changes take effect means you accept the updated Terms.
